These policies govern your use of the website vittiyalekha.com and the services provided by VittiyaLekha, operated by ARAVEDA TECHNOLOGY PRIVATE LIMITED ("VittiyaLekha", "we", "our", "us"). By using our website or engaging our services, you agree to the Terms of Use, Cancellation & Refund Policy, and Privacy Policy set out below.

Part ATerms of Use

1.Acceptance

By accessing our website, applications, or communication channels (including WhatsApp), or by availing our services (together, the "Services"), you confirm that you have read and agree to these Terms. If you do not agree, please stop using the Services. These Terms form a binding agreement between you and VittiyaLekha.

2.Definitions

  • Client / you: any person or entity that uses our website or Services.
  • Engagement: any order, subscription, or request for Services placed with us.
  • Government Fees: statutory charges payable to any government or regulatory authority (e.g., MCA fees, stamp duty).
  • Professionals: Chartered Accountants, Company Secretaries, lawyers, or other independent experts who may deliver parts of the Services.
  • Working Day: any day other than a Saturday, Sunday, or public holiday on which banks are open in Chennai, India.

3.Nature of Services & no professional advice

VittiyaLekha helps businesses manage compliance, tax, and statutory filing workflows, and may engage independent Professionals to deliver certain parts of the Services. Content on our website is for general information only and should not be treated as legal, tax, or financial advice. Please consult a qualified independent advisor before acting on any information. Use of the Services does not by itself create any attorney–client or similar fiduciary relationship.

4.Eligibility & your responsibilities

  • You must be at least 18 years old and legally able to enter into a contract under Indian law.
  • You are responsible for ensuring the information and documents you provide are true, complete, and current. We are not liable for issues caused by inaccurate or incomplete information from you.
  • You agree to respond and share required documents within communicated timelines. Delays on your side extend delivery timelines and may affect refund eligibility.
  • You consent to being contacted by phone, email, SMS, or WhatsApp for service delivery, support, and important updates.

5.Orders, pricing & payments

  • Quotes are indicative until full payment is received and the Engagement is confirmed.
  • Unless stated otherwise, prices are exclusive of applicable taxes (such as GST) and Government Fees, which are added to your final bill.
  • Payments may be made through approved payment gateways, bank transfer, UPI, or other methods we notify.
  • A tax invoice is issued in the name provided at the time of the order.

6.Timelines & delivery

  • All timelines are best-effort estimates and are not guaranteed; they depend on government portals, regulatory approvals, and your cooperation.
  • Commencement of work: work is treated as "commenced" once your payment is processed and your Engagement is logged for allocation — including preparatory work, resource assignment, or preliminary review by the assigned team.
  • On hold / abandonment: if you do not respond to our reminders for 15 calendar days, we may place the Engagement on hold. If there is no response for 45 calendar days in total, the Engagement is treated as abandoned and no refund applies.

Part BCancellation & Refund Policy

1.Our approach

We aim to be fair and transparent. This policy balances a fair outcome for you with the operational costs and non-recoverable government fees involved in delivering compliance services.

2.Cooling-off period

You are eligible for a refund if you cancel within 1 day of payment, provided work has not commenced (as defined in Part A, Clause 6).

3.Non-refundable components

Once paid on your behalf, the following are non-refundable under any circumstances:

  • All Government Fees (e.g., MCA fees, trademark application fees, stamp duty).
  • Third-party consumables such as a Digital Signature Certificate (DSC) or notarisation charges.
  • Payment gateway transaction charges (typically 1–3% of the transaction value).

4.Partial (pro-rata) refunds after work commences

If you cancel after the cooling-off period or after work has commenced, a partial refund may be considered, calculated on a pro-rata basis:

Refund = Total Paid − ( A + B )
A = non-refundable costs already incurred (see Clause 3)
B = a service fee for work already done, based on time spent at our standard rate

Illustration: You paid ₹10,000. We had purchased a DSC (₹2,500) and spent time on initial consultation and drafting (valued at ₹2,000). Your refund would be ₹10,000 − (₹2,500 + ₹2,000) = ₹5,500. Figures are illustrative only.

5.How to request a refund

  • Email enquiry@vittiyalekha.com or message us on WhatsApp at +91 88825 11529, with the subject "Refund Request – [Your Name / Entity]".
  • State the reason and include the registered email and phone number used for the order, for verification.
  • We acknowledge requests within 1 Working Day and communicate a decision within 3 Working Days of receiving all required details.
  • Approved refunds are processed to the original payment method within 3–5 Working Days of the decision.

6.Service quality issues

If you are dissatisfied, contact us with details of the issue. We will review the matter in good faith and, at our discretion, may offer corrective action, rework at no additional cost, or a credit note, consistent with applicable consumer-protection obligations.

7.When cancellation/refund is not possible

  • After documents or applications have been finally submitted to a government authority (e.g., an incorporation form uploaded to the MCA).
  • For time-sensitive or expedited services that have already been initiated.
  • For promotional or bundled services explicitly marked "non-refundable" at the time of purchase.

8.Escalation

If you are not satisfied with the resolution from our team, you may escalate by writing to enquiry@vittiyalekha.com (marked for the attention of our Grievance Officer). A senior team member will review and respond within 5 Working Days.

Part CPrivacy Policy

We are committed to protecting your privacy in line with India's Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023 (DPDP Act).

1.Data we collect

  • Identity & contact: name, PAN, Aadhaar details, DIN, address, email, phone number.
  • Service data: documents and information needed to deliver the Services you request.
  • Transactional data: services purchased, payment details, and invoices.
  • Technical & usage data: IP address, browser and device information, and how you use our website.

2.Why we process it

We process your data to deliver our Services to you, to meet legal obligations, for our legitimate interests (such as improving our Services), and — for marketing communications — with your consent.

3.Sharing & disclosure

We share your data only where necessary: with Professionals (CA/CS/lawyers), government authorities, and essential technology providers who support our Services. We do not sell your personal data.

4.Security & retention

We use reasonable technical and organisational measures, including access controls, to protect your data. We retain personal data only for as long as needed for the purposes it was collected or as required by law.

5.Your rights

You may request access to, correction of, or erasure of your personal data, and may withdraw consent to its processing. To exercise these rights, email enquiry@vittiyalekha.com.

Part DGeneral Legal Terms

1.Intellectual property

All content, branding, and technology on this website — including the "VittiyaLekha" name and logo — are owned by ARAVEDA TECHNOLOGY PRIVATE LIMITED and may not be copied or reused without our prior written consent.

2.Limitation of liability

To the maximum extent permitted by law, our total liability in connection with any Engagement shall not exceed the professional fees you paid to us for that specific Engagement. We are not liable for indirect or consequential loss, or for statutory penalties or interest arising from incorrect or delayed information provided by you.

3.Indemnity

You agree to indemnify and hold VittiyaLekha harmless from any claim, loss, penalty, or expense arising from your breach of these Terms, your violation of any law, or your provision of incorrect information.

4.Governing law & jurisdiction

These policies are governed by the laws of India. Subject to the dispute-resolution clause below, the courts at Chennai, India shall have exclusive jurisdiction over any dispute.

5.Dispute resolution

The parties will first try to resolve any dispute amicably. If it is not resolved within 30 days, it shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Chennai, India.

6.Changes to these policies

We may update these policies from time to time. The current version, with its "Last updated" date, will always be available on this page. Continued use of the website or Services after an update means you accept the revised policies.
